Terms of Service

1. Scope

These Terms of Service govern the use of all vehicle selection services provided by CanadaMtnLodge and outline the rights and obligations between clients and our luxury automotive selection service. By engaging our services, registering for consultations, or using our vehicle sourcing expertise, the client fully acknowledges and accepts these terms.

2. Service Provisions and Engagement

  1. Engagement of our selection services requires prior consultation and written confirmation.
  2. Certain premium or concierge services may require the completion of a client profile assessment and preference documentation.
  3. Vehicle information, selection portfolios, and access credentials are strictly confidential and for the client's personal use only.
  4. The final decision on vehicle purchases remains with the client, who assumes responsibility for their selection within our recommendations.

3. Service Contracts and Cancellation

  1. The service duration depends on the selection package chosen and is specified in the respective service agreement.
  2. Cancellation of standard selection services is possible without penalty up to 14 days after initial consultation if no vehicle sourcing has commenced.
  3. For premium and concierge selection packages that have progressed beyond the initial consultation stage, cancellation fees apply as outlined in the service agreement.
  4. Non-attendance at scheduled consultations or viewings without prior notice does not entitle the client to a refund of service fees.

4. Payment Terms

  1. Service fees are payable in accordance with the payment schedule detailed in the service agreement.
  2. For extended search engagements, a deposit structure may be offered with milestone payments.
  3. All prices are quoted in Canadian Dollars (CAD) and are subject to applicable taxes.
  4. Payments are processed through secure, encrypted channels with detailed receipts provided for all transactions.

5. Return Policy

  1. As CanadaMtnLodge provides professional services rather than products, our return policy pertains to service satisfaction and fee structures. For clients who have engaged our Standard Selection Package and wish to terminate services within 48 hours of signing the service agreement, a full refund will be provided if no substantial work has commenced. After this period, or if substantial work has been performed (including but not limited to market research, vehicle sourcing activities, or communications with sellers), fees are non-refundable but services may be adjusted to meet client expectations.
  2. For Premium and Concierge packages, the initial consultation fee is non-refundable under any circumstances, as it represents valuable professional time and expertise already delivered. The remainder of the package fee structure follows a pro-rated refund policy based on documented service milestones completed at the time of termination request.
  3. All refund requests must be submitted in writing to accounting@canadamtnlodge.com and will be processed within 10 business days following approval.
  4. This return policy does not apply to third-party costs incurred during the selection process (e.g., vehicle inspection fees, transportation costs) which are passed through to the client at actual cost.

6. Client Conduct and Responsibilities

  1. Mutual respect and professional communication are fundamental principles throughout the selection process.
  2. Clients are expected to provide accurate information regarding their requirements, preferences, and financial parameters.
  3. Timely responses to vehicle proposals and recommendations are essential to maintain an efficient selection process.
  4. CanadaMtnLodge reserves the right to terminate services without refund in cases of client conduct that impedes the selection process or violates ethical standards.

7. Service Outcomes and Assurances

  1. While we exercise the highest standards of due diligence, the final responsibility for vehicle selection decisions rests with the client.
  2. Our service guarantees thorough market research and access to our exclusive network, but cannot guarantee the availability of specific rare or limited-production vehicles within a predetermined timeframe.
  3. Vehicle inspections and assessments are conducted with professional diligence, but do not constitute a warranty on the vehicle's condition or future performance.
  4. We strive to provide exceptional service and value, but cannot guarantee specific investment outcomes or future appreciation of selected vehicles.

8. Liability and Warranty

  1. CanadaMtnLodge assumes no liability for damages arising from client decisions following our advisory services.
  2. Liability for minor negligence is excluded to the extent permitted by law.
  3. Our service availability is maintained with the utmost care, though temporary disruptions due to technical or market conditions cannot be completely ruled out.
  4. No warranty is provided regarding the accuracy of market valuations or projections, as luxury automotive markets are subject to fluctuation.

9. Intellectual Property and Confidentiality

  1. All selection reports, market analyses, and proprietary sourcing methods remain the intellectual property of CanadaMtnLodge and may be used by clients for personal decision-making only.
  2. The redistribution, publication, or commercial use of our research materials is prohibited without express written consent.
  3. Client information and vehicle preferences are treated with strict confidentiality in accordance with our Privacy Policy.

10. Final Provisions

  1. Should individual provisions be ineffective, the validity of the remaining provisions remains unaffected.
  2. Canadian law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
  3. The jurisdiction for all disputes is Vancouver, British Columbia, Canada.
